Welcome to the Skin & Aesthetics by Haleema website at www.skinaestheticshaleema.co.uk (the “Website”).

These Website Terms of Use (“Terms”) govern your access to and use of the Website. They apply to all visitors and users of the Website.

These Terms relate primarily to use of the Website. Appointments, treatments, memberships, packages, gift vouchers, promotions and other purchases may also be governed by separate terms, policies, consent documents and treatment-specific information made available before booking or purchase. Where there is a conflict, the terms that apply specifically to the relevant booking, treatment or purchase will take priority.

Nothing on the Website creates a treatment relationship or obliges us to provide a service. A contract for a booking or purchase is formed only when we accept it and issue confirmation through our booking, payment or communication system.

About us and your contracting party

“Skin & Aesthetics by Haleema” is a trading name used for services delivered from our Edgbaston and Sutton Coldfield clinics.

The company operating the clinic at which your appointment is booked will be the provider of the relevant services and your contracting party. Your booking confirmation, receipt or invoice should identify that company. In these Terms, “we”, “us”, “our” and “the Clinic” refer to the relevant operating company unless the context requires otherwise.

Acceptance and legal capacity

By using the Website, you agree to comply with these Terms. If you do not agree, you should stop using the Website.

You may browse the Website if you are under 18, but you may not independently enter into a contract or make a payment through it. A parent or legal guardian may need to make or authorise bookings for treatments that the Clinic lawfully offers to persons under 18, subject to our age, consent and safeguarding requirements.

Age restrictions

It is unlawful in England to administer, or make arrangements to administer, botulinum toxin or cosmetic filler by injection for a cosmetic purpose to a person under 18, except in the limited circumstances permitted by law. Parent or guardian consent does not override this restriction.

We may require satisfactory proof of age before accepting a booking and again before treatment. We may refuse or cancel a booking where age cannot be verified.

Other treatments may also be subject to legal, manufacturer, insurance or Clinic minimum-age requirements. Please contact us before attempting to book any treatment for a person under 18.

Permitted use of the Website

You may use the Website only for lawful, personal and non-commercial purposes. You must not:

  • attempt to gain unauthorised access to the Website, its hosting, systems or data;
  • introduce viruses, malware or other harmful code;
  • interfere with the operation, security or availability of the Website;
  • use automated tools to scrape, harvest or reproduce Website content without written permission;
  • impersonate another person or submit false, misleading or fraudulent information;
  • use the Website in a manner that infringes the rights of another person; or
  • use the Website for unlawful, abusive or harmful purposes.

We may restrict or suspend access where we reasonably suspect misuse, a security risk or a breach of these Terms.

This policy allows us to manage our schedule fairly and continue offering the best possible service to all clients. 

Medical information disclaimer

The Website provides general educational and informational content. It does not constitute individual medical advice, diagnosis, prescribing advice, treatment recommendation or healthcare advice tailored to your circumstances.

Treatment suitability can be determined only after an appropriate consultation and assessment by a suitably qualified practitioner. You should not rely on Website content as a substitute for advice from your doctor, pharmacist or other qualified healthcare professional, and you should not delay seeking medical advice because of information on the Website.

The Website and its contact forms are not monitored as an emergency medical service. If you believe you have a medical emergency or require urgent medical attention, contact NHS 111, call 999 where appropriate, attend an emergency department or contact another suitable healthcare provider.

Consultations and treatment information

Information about treatments, benefits, risks, expected results, recovery periods and longevity is general guidance only. Outcomes and recovery vary between individuals and may be affected by age, medical history, medication, skin type or condition, lifestyle, genetics and compliance with preparation and aftercare instructions.

No treatment outcome, duration of result or absence of side effects can be guaranteed. Before-and-after photographs and testimonials are examples of individual experiences and do not guarantee that another person will achieve the same result.

Treatment availability, protocols, products, devices and practitioners may change. Treatments may require one or more of the following before they can proceed:

  • consultation or clinical assessment;
  • medical history review;
  • prescribing assessment;
  • cooling-off period;
  • patch test;
  • photographs;
  • consent documentation; and
  • payment of an applicable fee.

 

We may decline, postpone or discontinue treatment where it is clinically inappropriate, unsafe, outside our scope of practice, contrary to law, manufacturer guidance or insurer requirements, or where adequate consent cannot be obtained.

All appointments booked under a membership remain subject to the clinic’s Appointment Lateness, Cancellation, Rescheduling, and No-Show Policy. Where a membership appointment is cancelled, rescheduled, or missed within 72 hours of the scheduled appointment time, the appointment may be treated as used and deducted from the member’s entitlement. Should the member wish to rebook the forfeited treatment session, the full cost of that treatment session will apply. 

Membership payments contribute towards access to treatments, discounts, exclusive benefits, and reserved clinic capacity. Membership fees remain payable regardless of whether appointments are booked or attended during a particular month. Memberships may only be cancelled after completion of the applicable minimum membership term. Following the minimum term, members must provide a minimum of four weeks’ written notice prior to their next billing date to cancel their membership.

Online enquiries and bookings

Submitting an enquiry or requesting an appointment does not mean that it has been accepted. A booking is confirmed only when we issue confirmation and any required payment has been successfully received.

Bookings are subject to practitioner availability, age verification, medical suitability, consultation requirements, patch testing, prescribing arrangements and compliance with the applicable booking and treatment terms.

You are responsible for checking the details in your confirmation and notifying us promptly of any error. You must provide accurate contact, identity, medical and payment information. We may refuse or cancel a booking if information is incomplete, inaccurate or misleading, or if payment is reversed or not authorised.

After an online booking or purchase, we will provide confirmation by email, SMS, through our booking system or another durable format that you can retain. You should keep a copy of the confirmation and the terms that applied at the time of booking.

Distance contracts and statutory cancellation rights

Where you enter into a consumer contract with us online, by telephone or away from our premises, you may have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Whether a statutory cancellation right applies can depend on the nature of the service and the circumstances of the booking.

Where the statutory right applies, you will normally have 14 days from the day after the contract is entered into to cancel without giving a reason. To cancel, you must send us a clear statement by email or another method identified in the applicable booking or purchase terms.

If you ask us to begin providing a service during the statutory cancellation period, we may require your express request. If you later cancel, you may be required to pay a proportionate amount for services already supplied. Where the service has been fully performed within the cancellation period following your express request and acknowledgement, the statutory right to cancel may be lost.

Some contracts may fall within a statutory exception. Any exception, restriction or loss of a cancellation right will be explained before the relevant purchase where it applies. Nothing in these Terms removes any cancellation or refund right that the law gives you.

Prices, payments and promotions

We take reasonable care to display accurate prices and information. Prices may change for future bookings, and treatments or promotions may be introduced, amended or withdrawn without notice.

A price change will not affect a booking or purchase that we have already accepted and confirmed, except where there is an obvious pricing error. If we identify an obvious error before providing the service, we will contact you and offer the choice of proceeding at the correct price or cancelling for a refund of sums paid for the affected service.

Unless stated otherwise, prices are in pounds sterling and include VAT where applicable. Additional charges will be disclosed before you complete a purchase.

Promotions may be subject to eligibility requirements, expiry dates, booking windows, treatment restrictions and separate promotional terms. Offers cannot be combined unless expressly stated.

Payments may be processed by third-party providers. Their terms and privacy information may also apply. We do not receive or store all card details entered directly into a secure payment provider’s system.

Booking fees, cancellations and rescheduling

Booking fees, deposits, cancellations, rescheduling, lateness, no-shows and package-session deductions are governed by the Booking and Cancellation Policy shown before or at the time of booking and incorporated into the relevant contract.

Any amount retained following cancellation will be applied in accordance with the applicable terms and consumer law. We will not rely on a term to retain payment where doing so would be unlawful or unfair, and any charge should reflect the circumstances of the cancellation and the loss reasonably incurred, subject to any statutory rights.

Where we cancel and cannot provide a suitable alternative, we will refund sums paid for the affected service unless another lawful remedy is agreed with you.

Memberships, packages, gift vouchers and finance

Memberships, prepaid packages, gift vouchers, promotional bundles and payment plans are governed by their own terms, including any minimum term, payment schedule, expiry date, usage limits, treatment frequency, cancellation rules, transfer restrictions and benefits.

You must read the applicable terms before purchase. Finance or instalment arrangements offered by an independent provider, including any buy-now-pay-later provider, are also subject to that provider’s terms, eligibility assessment and privacy information. A finance agreement is separate from your treatment contract with us.

Clinical suitability remains required even where a treatment has been prepaid. If a treatment becomes clinically unsuitable, the applicable package, membership and consumer-law provisions will determine whether an alternative, credit or refund is available.

Intellectual property

Unless stated otherwise, the Website and its content are owned by us or used under licence. This includes our trading names, branding, logos, photographs, videos, graphics, treatment guides, text, blogs, downloads, icons, design and marketing materials.

You may view the Website and print or download reasonable extracts for personal, non-commercial reference. You must not reproduce, modify, publish, distribute, sell, commercially exploit, remove branding from or create derivative works from Website content without our prior written permission, except where the law permits it.

Information you provide to us

When you contact us, submit a form, book or purchase, you must provide information that is accurate, truthful, complete and up to date. You must not knowingly provide false identity, contact, payment or medical information.

Incomplete or inaccurate medical information can affect treatment suitability and safety. You must update us if relevant information changes before treatment.

Do not send urgent medical information through a general Website contact form. Do not submit information about another person unless you are authorised to do so and it is lawful.

Third-party websites and service providers

The Website may link to, embed or integrate services operated by third parties, such as booking platforms, payment providers, finance providers, maps, social-media platforms, video services and analytics providers.

We are not responsible for the content, availability, security or privacy practices of an independent third-party website or service. A link does not necessarily mean that we endorse all content or services offered there. Your use of a third-party service may be governed by its own terms and privacy information.

Website availability and security

We aim to keep the Website available and accurate but do not guarantee uninterrupted, error-free or continuously secure access. We may suspend, withdraw, change or restrict all or part of the Website for maintenance, security, legal, technical or business reasons.

Subject to the paragraph above, we are not responsible for losses caused solely by your use of, or inability to access, the Website where the loss was not reasonably foreseeable when you began using it. We are not responsible for business losses where you use the Website wholly or mainly for commercial purposes.

The Website disclaimer and this liability section do not remove or reduce any duty owed in relation to a consultation or treatment. Treatment-related concerns and claims will be considered under the applicable clinical, contractual and legal obligations.

Privacy, cookies and electronic communications

Our Privacy Policy explains how the relevant data controller collects, uses, shares, retains and protects personal information, including health information and other special-category data. Our Cookie Policy explains the cookies and similar technologies used by the Website and how preferences can be managed.

Where required, non-essential analytics and advertising cookies will be used only after appropriate consent has been obtained through the Website’s cookie controls.

We may send service communications that are necessary to manage enquiries, consultations, bookings, payments, treatment preparation, aftercare, safety, complaints and changes affecting your contract. These are different from promotional marketing messages.

We will send electronic marketing only where permitted by law. Where consent is relied upon, it will be requested separately and may be withdrawn at any time using the unsubscribe method provided or by contacting us. Withdrawing marketing consent will not stop necessary service communications.

Changes to these Terms

Changes will apply to use of the Website after publication. They will not retrospectively alter an existing confirmed contract unless the applicable contract permits the change and the change is lawful and fair.

General legal provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. A delay or failure to enforce a right does not mean that the right has been waived.

These Terms do not give any third party a right to enforce them under the Contracts (Rights of Third Parties) Act 1999, except where the law provides otherwise.

Headings are included for convenience and do not affect interpretation.

Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident in England or Wales, the courts of England and Wales will generally have jurisdiction. If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts of the country in which you live. Nothing in this section affects any mandatory consumer right available to you.
